Welcome to Bounce Town Inc. where we strive to provide a safe, clean and fun atmosphere. In consideration of myself, my child(ren) or ward, participation in the inflatable equipment located inside, I acknowledge and agree on behalf of myself, my child(ren) or ward, identified above that:
1.
I,
my child(ren) or ward, are physically fit to participate in all activities at
Bounce Town Inc. and I agree to attend to and monitor the activities of myself,
my child(ren) or ward, such that all activities are appropriate for myself, my
child(ren) or ward; and
2.
I,
for myself and my child(ren) or ward, knowingly and freely assume all such
risks, both known and unknown, even if arising from the negligence of Bounce
Town, Inc., or others, and assume full responsibility for myself and my
child(ren) or ward’s participation at Bounce Town Inc.; and
3.
The
risk of serious injury by participating in Bounce Town Inc.’s activities,
although minimal, does exist and includes the potential for paralysis and/or
death; and
4.
I,
for myself, child(ren) or ward, willingly agree to comply with the stated terms
and conditions for participation and to obey the directions and requests of
Bounce Town Inc.’s staff. If I observe
any hazards during my presence or participation, I will remove myself and my
child(ren) from the participation and bring said hazard to the attention of the
nearest Bounce Town Inc. employee or official immediately; and
5.
I,
for myself, my child(ren) or ward, and on behalf of my heirs, assigns, personal
representatives and next of kin, HEREBY WAIVE, RELEASE, AND HOLD HARMLESS Bounce Town Inc., and its officers, agents,
employees, and other participants with respect to any and all claims for personal
injury, disability, death, or loss or damage to person or property, even if
arising from the negligence of Bounce Town Inc. or otherwise; and
6.
This
release and waiver extends to all acts of negligence by Bounce Town Inc. and is
intended to be as broad and inclusive as permitted by the laws of the State of
Texas, and if any portion of the agreement is held invalid, it is agreed that
the balance shall, notwithstanding, continue in full legal force and effect.
7.
I
RELEASE AND AGREE TO HOLD HARMLESS AND INDEMNIFY BOUNCE TOWN INC. FROM ANY AND
ALL LIABILITIES INCIDENT TO MYSELF, MY MINOR CHILD(REN) OR WARD’S INVOLVEMENT
OR PARTICIPATION IN BOUNCE TOWN INC.’S ACTIVITIES, INCLUDING SUCH LOSS,
LIABILITY, DAMAGE OR COST (INCLUDING ATTORNEY FEES) EVEN IF SUCH ACTION ARISES
FROM THE NEGLIGENCE OF BOUNCE TOWN INC. TO THE FULLEST EXTENT PERMITTED BY LAW.
I HAVE READ THIS RELEASE AND WAIVER OF
LIABILITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN
UP SUBSTANTIAL RIGHTS FOR MYSELF AND MY CHILD(REN) BY SIGNING IT, AND SIGN IT
FREELY AND VOLUNTARILY WITHOUT INDUCEMENT.
